Motorcyclists and their passengers are provided less protection than the occupants of other types of motor vehicles, and because of this, many motorcycle accidents result in devastating injuries to the rider. Brain injuries, spinal cord injuries, amputations, fractures, or even death are common in motorcycle accidents.

Most people do not ride motorcycles. They often see inexperienced motorcyclists speeding or engaging in reckless driving. Because of the behavior of this minority group of motorcyclists, the general public has misconceptions about the majority of motorcyclists. They do not understand that most motorcycle accidents are caused by the driver of automobiles, not the motorcyclist. This is a bias that must be addressed and overcome in any jury trial.

The driver's insurance company is going to immediately start an investigation with one goal in mind: PAY AS LITTLE AS POSSIBLE TO SETTLE THE CASE. They will have investigators on the ground within hours of the collision. They will take photographs, interview witnesses, and try to secure as much physical evidence as possible. In fact, they will usually hire an attorney to represent the wrongdoers rights throughout the process, even at trial.

If you were injured in a motorcycle accident, you should be thoroughly examined by a trusted physician as soon after the collision as possible. You should also have someone you trust take pictures of the cars and the motorcycle involved, and the accident scene. Use a film camera (not digital) to take multiple pictures of the cars and the motorcycle. A Kodak Max disposable camera is an extremely reliable camera to use for this purpose. When taking pictures of the cars and motorcycle, pretend there is a clock dial around the vehicles. Take pictures from the 12 o'clock position, the 1 o'clock position, 2 o'clock position, etc. You should end up with 12 good pictures showing a 360 degree view of the vehicles. Use the rest of the camera to take pictures of the damaged areas of the cars and motorcycle, and the accident location.

motorcycle accidentUse a second camera to take pictures of injured parts of your body. Cuts, bruises, road rash, and other injuries need to be documented. Remember, spending $15 on pictures can substantially add to the value of your case. You can never have too many. Don't wait to use the whole roll of film before you get the pictures developed. If you wait, you may find out that the pictures did not come out well. If two weeks have gone by, those wounds may look completely different. It will then be too late to get pictures to show the jury. Take pictures, use the whole roll, and have someone get them developed the same day. This way, if the pictures do not come out, you can immediately take new pictures. If your injuries are severe, it is critical to have a professional legal photographer take pictures to document the evidence for a jury.

Don't trust your own insurance company to take pictures or do anything else related to your case. Insurance companies are not legally allowed to act as your attorney. They have their own interests in mind and they may not align with your own. In fact, you can be confident that any insurance company that contacts you after an accident has only one primary goal in mind: PAYING YOU AS LITTLE AS POSSIBLE.
